Welcome to the Ember Companion, operated by Ember Health Inc. ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Ember Companion, our website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Purpose of the Service

The Ember Companion is designed to provide educational information, emotional support, and navigational guidance for individuals and families facing cancer. The Service aims to simplify complex medical information, reduce emotional overwhelm, support caregiver decision-making and preparation, and provide clarity during moments of confusion or crisis. The Service does not provide medical advice.

2. Not Medical Advice

The Ember Companion is not a doctor, clinician, therapist, lawyer, or financial advisor. The Service does not diagnose, treat, or cure medical conditions; provide individualized clinical guidance; interpret imaging or labs with clinical authority; replace licensed healthcare providers; or offer legal, financial, or professional advice.

Always consult qualified healthcare providers for medical decisions. If you believe you may be experiencing a medical emergency, call 911 or seek immediate medical care.

3. Eligibility

You may use the Service only if you are 18 years or older, or using the Service with parental or guardian supervision. The Service is not intended for unsupervised use by minors.

4. User Responsibilities

By using the Service, you agree that you will:

• Use the Service only for lawful and personal purposes
• Avoid sharing highly identifiable personal information unless necessary
• Not input harmful, offensive, or illegal content
• Not attempt to disrupt, reverse-engineer, or misuse the Service
• Not use the Service to harass, threaten, or harm others

You are responsible for all information you choose to submit.

5. Data Usage

By using the Service, you acknowledge and agree to the following data-handling practices.

5.1 Processing of conversation data

Your messages and interactions are processed by Chatbase, the secure third-party platform powering the Agent. Chatbase processes data solely to generate responses, maintain platform performance and safety, provide analytics, and support system operations. Chatbase does not use customer data to train generalized AI models.

5.2 De-identified data, derived analytics & monetization

Ember Health Inc. may analyze de-identified, aggregated, or derived data from user interactions to improve Service quality and accuracy; develop emotional health and quality-of-life metrics; support research into caregiver and patient needs; produce population-level insights, dashboards, or reports; collaborate with advocacy groups, healthcare organizations, and researchers; and create commercial products, services, or analytics offerings, including insights sold or licensed to institutions, partners, or enterprises.

No identifiable personal information is ever sold or monetized. Only de-identified, aggregated, or derived data may be commercialized.

5.3 No sale of personal data

We do not sell, rent, trade, or transfer identifiable personal information to third parties. Monetization applies only to aggregated data, statistical patterns, emotional and linguistic trends, anonymized quality-of-life models, and derived analytics.

5.4 Technical and device information

Chatbase may collect technical metadata such as IP address (general region only), browser and device type, operating system, and activity logs and time stamps. This supports performance, analytics, fraud prevention, and security.

5.5 User rights and control

You may request at any time access to your identifiable data, correction of inaccuracies, deletion of identifiable data, and restriction of processing where legally applicable. Deletion requests apply only to identifiable data. De-identified or derived data integrated into aggregated datasets cannot be retracted. To make a request, contact hello@emberhealth.ai.

5.6 Sensitive information

The Service is not a HIPAA-covered entity. Users should avoid submitting identifiable medical records or sensitive personal data unless necessary. Information shared is handled according to these Terms and our Privacy Notice.

5.7 Security and compliance

All data is encrypted in transit and at rest. Chatbase maintains SOC 2 Type II and GDPR-aligned compliance controls. Ember Health Inc. applies industry-standard security measures and does not attempt to re-identify anonymized data.

6. Intellectual Property

All content associated with the Ember Companion — including AI responses, emotional-health frameworks, Precision Empathy methodology, dQoL metrics, the Sorrow Lattice, research outputs, branding and design, and system instructions — is the exclusive property of Ember Health Inc. You may not copy, reproduce, distribute, or modify this content without written permission.

7. Acceptable Use Restrictions

You agree not to use the Service for commercial purposes without authorization, attempt to scrape or extract data from the platform, introduce malware or harmful code, bypass security measures, or misuse or abuse the Service. Violation of these restrictions may result in suspension or termination of access.

8. Termination

We may suspend or terminate access to the Service if you violate these Terms, you misuse the Service, or it is required for legal, security, or operational reasons. You may discontinue use at any time.

9. Third-Party Services

The Service relies on Chatbase and other third-party providers. Your use of the Service is subject to their respective terms and privacy practices. We are not responsible for the availability, functionality, or performance of third-party systems.

10. Governing Law

These Terms are governed by and shall be interpreted in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising out of or related to these Terms or the use of the Service shall be resolved exclusively in the state or federal courts located in Delaware, unless applicable law requires otherwise. By using the Service, you consent to the jurisdiction and venue of such courts.

11. Modifications to the Terms

We may update these Terms from time to time. Changes become effective upon posting a revised "Last Updated" date. Continued use of the Service constitutes acceptance of the updated Terms.
